Welcome to Luxnova – The Global Estate Collection (“Luxnova,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Luxnova website, platform, products and services (collectively, the “Service”) at www.luxnova.estate. By registering for or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Definitions

  • User, you or your: any person who accesses or uses the Service.
  • Free Partner, Premium Partner, Elite Partner: the three membership tiers described on our “Partner Tiers” page.
  • Member Content: all content you submit through the Service, including property listings, inquiries, profiles and messages.
  • Third-Party Services: services or content provided by partners, advertisers or other users.

3. Eligibility

You must be at least 18 years old and capable of entering binding contracts in your jurisdiction. If you register on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

4. Account Registration & Security

  1. Account Creation: You must provide a valid email address, password and any other requested information to register.
  2. Accuracy: You agree to keep your account information accurate and up-to-date.
  3. Security: You are solely responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

5. Services & Subscriptions

  1. Free Partner: one active property listing for 30 days.
  2. Premium Partner: up to 25 active listings, lead-platform access, optional MLS add-on, pay-per-use concierge and marketing.
  3. Elite Partner: unlimited listings, full MLS, concierge access, priority leads, marketing tools and contract/email templates.
  4. Billing: All paid plans are billed via WooCommerce Subscriptions. You authorize us to charge your chosen payment method (Stripe, PayPal, SEPA or supported crypto gateway) for recurring fees until you cancel.
  5. Auto-Renewal: Subscriptions renew automatically on each billing cycle. You may cancel or change your plan at any time from your Dashboard; cancellations take effect at the end of the current term.
  6. Promotions: Discount codes or promotional offers (e.g. LUX1000) are subject to eligibility, quota and expiration. We reserve the right to modify or terminate promotions at any time.

6. Property Listings & Transactions

  1. Accuracy of Listings: You warrant that all information, images and documents you submit are truthful and you have the legal right to list the property.
  2. User-to-User Transactions: Luxnova is a platform facilitator only. We do not broker, appraise or guarantee any transaction. Any contract or payment occurs directly between users, and you are solely responsible for due diligence.
  3. Inspection Services: We may arrange on-site inspections for a fee. Our agents do not attend inspections unless separately contracted, and Luxnova disclaims all liability for inspection outcomes.

7. Token & Crypto Payments

  1. Luxnova Token (LUX): Users may purchase and spend LUX tokens within the platform. Token purchases are final and non-refundable.
  2. Crypto Gateways: We support BTC, ETH, USDT, BNB and others via our selected payment processor. You assume all risk of price volatility and transaction fees. Tokens and crypto are not legal tender.

8. Concierge & Add-On Services

  1. Service Catalog: Concierge and add-on offerings are listed with descriptions, pricing and delivery estimates.
  2. Ordering & Payment: All orders are processed via WooCommerce. Concierge services may require additional agreement.
  3. No Refunds: Unless otherwise stated, all purchases of services and add-ons are final.

9. Internal MLS & Collaboration Tools

  1. Access Control: MLS features are restricted to subscribed Premium and Elite Partners.
  2. Content Sharing: You may share and collaborate on listings with other Partners.
  3. Contract Generator: Draft contracts are provided for convenience. You remain responsible for verifying accuracy and obtaining legal advice.

10. Lead Platform & CRM

  1. Lead Capture: We collect leads via forms and third-party integrations. We do not guarantee lead quality or conversion.
  2. User Obligations: You agree to comply with all applicable telecommunications and anti-spam laws when contacting leads.

11. Intellectual Property

  1. Our IP: Luxnova trademarks, logos, design elements, software and content are owned by Luxnova or licensed to us.
  2. Your Content: You retain ownership of Member Content but grant Luxnova a worldwide, royalty-free license to display, distribute and promote it within the Service.
  3. Prohibited Use: You may not copy, modify, create derivative works of, or scrape any part of the Service without our express written permission.

12. Prohibited Conduct

You agree not to:

  • Violate any law or third-party right;
  • Use the Service to transmit malware or spam;
  • Harvest personal data of other users;
  • Impersonate any person or entity;
  • Interfere with the Service’s integrity or performance.

13. Disclaimers & Limitation of Liability

  1. No Warranties: THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” LUXNOVA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
  2. No Liability for Third Parties: We are not responsible for the acts or omissions of any users, agents, brokers or developers.
  3. Limitation of Damages: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LUXNOVA BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify and hold harmless Luxnova and its officers, directors, employees and agents from any claims, liabilities, damages, losses or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your breach of these Terms or your violation of any law or third-party right.

15. Privacy & Data Protection

Your use of personal data is governed by our Privacy Policy, available at www.luxnova.estate/privacy-policy. We comply with GDPR and respect your rights of access, correction and deletion.

16. Termination

We may suspend or terminate your access for any reason, including breach of these Terms, at our sole discretion. Sections 6, 11–15, and 17–19 survive termination.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of Belgium without regard to conflict‐of‐law principles. Any dispute arising from these Terms shall be resolved by the courts of Brussels, Belgium.

18. Changes to Terms

We may revise these Terms at any time by posting the updated version at www.luxnova.estate/terms-and-conditions. Your continued use of the Service after any change constitutes acceptance of the new Terms.
